This document governs the terms and conditions applicable to the purchase and use of the digital products offered through the website nextsim.racing and the related services.
2. Subject of the Agreement
These Terms govern the sale of software licenses related to the following products:
Next Plugin
Next Dashboard
distributed under the Next Sim Racing brand.
The Seller provides:
downloadable software (plugin and dashboard),
ancillary digital services,
features unlocked through a paid digital license.
The software may be downloaded free of charge; however, certain features are available exclusively upon activation of a license associated with a subscription plan.
3. Nature of the Product
The purchase does not result in the sale of the software, but in the granting of a personal, non-transferable license to use, as specified in the applicable EULA (End User License Agreement).
4. Account and Authentication
Access to licensed features requires authentication via the user’s Discord account. The user is responsible for:
the security of their Discord account,
all activities carried out through that account,
the accuracy of the data provided.
The license is personal and linked to the Discord account used at the time of purchase.
5. License Type
Unless otherwise stated, the granted license is:
personal,
non-transferable,
non-exclusive,
usable on multiple devices not simultaneously,
associated with a single Discord account.
The following are strictly prohibited:
assignment or resale of the license,
sharing the license with other users,
simultaneous use on multiple devices.
Device changes are allowed in accordance with the technical rules of the licensing system.
6. Plans, Pricing and Duration
The following plans are available:

Rookie
Pro
Prices:
are expressed in euros (€),
are monthly or annual,
include any applicable taxes under current law.
Up-to-date details regarding plans and pricing are displayed on the website at the time of purchase. The Seller reserves the right to modify prices and plans for new purchases only, without affecting active subscriptions.
7. Payments
Payments are processed via Stripe Checkout, using the payment methods available at the time of purchase.
8. Subscriptions and Automatic Renewal
Subscriptions are subject to automatic renewal, unless canceled by the user before the end of the current billing period. Renewals are managed through the Stripe platform.
9. Cancellation
Users may cancel their subscription at any time. Cancellation takes effect at the end of the already paid billing period. No refunds are provided for partially used periods.
10. Failed Payments and Outstanding Amounts
In the event of a failed payment:
Stripe will automatically attempt up to 8 retries over approximately 14 days,
if all attempts fail, the subscription will be canceled,
access to paid features will be suspended or revoked.
In the event of a dispute or chargeback, the license associated with the account may be immediately suspended until the dispute is resolved.
11. Withdrawal and Refunds
Pursuant to Article 16(m) of Directive 2011/83/EU on consumer rights and applicable consumer protection laws, the right of withdrawal is excluded for the supply of digital content with immediate access, provided that the user has given explicit consent. Before completing the purchase, the user:
agrees to the immediate provision of the digital content;
acknowledges the loss of the right of withdrawal.
Accordingly, no refunds are automatically due. However, the Seller may, at its sole discretion, grant refunds in specific circumstances, including but not limited to:
verified technical malfunctions preventing the proper use of the software;
billing errors or duplicate charges;
unauthorized payments.
Refund requests must be submitted via support@nextsim.racing within 7 days from the date of purchase. All requests are evaluated on a case-by-case basis and, unless required by mandatory law, refunds are not guaranteed.
12. Service Availability and Grace Period
The Seller undertakes to ensure reasonable availability of license verification services, without guaranteeing uninterrupted continuity. In the event of temporary server unavailability:
the software may continue to function for a grace period,
the duration of the grace period may vary and is determined by the Seller.
The Seller reserves the right to suspend access to licensed features if verification is not possible for an extended period.
13. Discounts and Coupons
Any discounts or promotional codes:
may be used only once,
are not cumulative,
are valid only for the specified period.
14. Updates and Modifications
Software updates may be:
automatic or manual,
distributed via the Seller’s servers.
Updates may introduce:
new features,
technical changes,
fixes or removal of existing features.
15. Limitation of Liability
The software is provided “as is”. To the fullest extent permitted by law, the Seller shall not be liable for:
indirect or consequential damages,
loss of data,
service interruptions,
malfunctions caused by system configurations, third-party software, or improper use.
Use of the software is at the user’s own risk.
16. Prohibited Use
The following are strictly prohibited:
reverse engineering, decompilation, or modification of the software,
bypassing or attempting to bypass the licensing system,
distributing, reselling, or sharing the software or installer,
using the software in violation of these Terms.
Violations may result in suspension or revocation of the license without refund.
17. Intellectual Property
All intellectual property rights in the software, brand, and content belong to the Seller. Any unauthorized reproduction, distribution, or modification is prohibited..
18. Minimum Age
The services are intended exclusively for users aged 18 or older. By using the service, the user declares that they are at least 18 years old.
19. Amendments to the Terms
The Seller reserves the right to amend these Terms at any time. Amendments shall become effective upon publication on the website.
20. Governing Law and Jurisdiction
These Terms and Conditions are governed by Italian law. For any dispute, the court of the consumer’s place of residence or domicile shall have jurisdiction, where applicable.
21. Support
Support is provided through the channels indicated on the website. Estimated response times are 24–48 business hours, subject to availability. Support is provided on a best-effort basis.
